KXTE “XTREMERADIO.COM FOOTBALL POOL” OFFICIAL CONTEST RULES

NO PURCHASE NECESSARY TO ENTER TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.

1. How to Enter the Contest:

a. The KXTE “XTREMERADIO.COM Football Pool” Contest will begin on Sunday, September 9, 2008 at approximately 9:00 am Pacific Time (“PT”) and end on Sunday, December 30, 2008 at approximately 11:00am PT.

b. To participate in the contest and in order to be eligible for a chance to win, listeners must submit their weekly football picks on our website, www.xtremeradio.com.   Listeners must pick a winner for each of the football games played each week, starting with the games played on Sunday, September 7, 2008 (for the purposes of this contest, each week runs from Sunday through, and including, Saturday).  Along with their pick of winners, listeners must also provide a guess of the total amount of points scored in each Monday game, which will be used in case of a tie. Some weeks their will be two games on Monday nights, so the listener will have to pick the winner of each game.  Then we will select which game will be used as the tie breaker.  The listener with the most correct picks will be selected as the weekly winner, upon confirmation of eligibility.    The seventeen (17) weekly winners (one (1) winner for each of the seventeen (17) weeks) will receive $100 American Express Gift Card, one (1) 6-pack of Coors Light Beer, and $25 Carter Powersports gift certificate.  Weekly entries must be in no later than 9:00am PT every Sunday starting on September 7, 2008, continuing through Sunday, December 28, 2008, which will be the last day to submit an entry.  Any entries received after 9:00am PT on each Sunday will be ineligible to compete in that week’s contest. 

c. When entering online listeners must enter their first name, last name, complete address, city, state, zip code, home telephone number, date of birth and valid e-mail address on the online entry form.  One entry per person, per email address, per week, for seventeen (17) weeks.  Internet entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses of the domain associated with the submitted e-mail address.  Multiple participants are not permitted to share the same email address.  All entries submitted become the sole property of the Station and will not be acknowledged or returned.  Use of any device to automate entry is prohibited.  Proof of submission of an entry shall not be deemed proof of receipt by Station.  Station’s computer is the official time keeping device for the sweepstakes

d. KXTE is not responsible for lost, stolen, mangled, misdelivered, illegible, incomplete, or late entries.  KXTE is also not responsible for entries not received due to difficulty accessing the internet, service outages or delays, computer difficulties, equipment malfunctions and other technological glitches.

e. One entry per person, per week, for the duration of the contest.

2. Eligibility Restrictions:

a. The contest is open to all KXTE listeners who are 21 years of age or older who reside in the Las Vegas area, including Clark County and Nye County and are legal residents of Nevada.  Employees of KXTE (the “Station”), its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Las Vegas metropolitan area and the members of their immediate families and/or households are ineligible to participate and win

b. Listeners are eligible to win a KXTE contest only once every thirty (30) days.  Only one winner per household is permitted in any contest.

c. Listeners are eligible to win a prize valued at $600.00 or more only once every six months.

d. Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

3. Prizes:

a. Seventeen (17) weekly winners will each receive one (1) $100 American Express Gift card, one (1) 6-park of Coors Light Beer, and (1) $25 Carter Powersports Gift Certificate. Approximate Value: $130.

b. All prizes or prize certificates may be picked up at KXTE Business Office 6655 W Sahara Suite D110 Las Vegas, NV 89146. The winner will forfeit any prize or prize certificate not claimed within ten (10) business days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. KXTE is not responsible for the safe arrival of a prize or prize certificate.

c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the items listed above and do not include taxes, gratuities, or any other expenses. Other restrictions may apply.

4. Selection of Winners:

a. Decisions of KXTE station management with respect to the contest are final.

b. Each week during the contest beginning, the listener with the most correct picks for that week will be selected as the weekly winner, upon confirmation of eligibility.  Winner will be contacted on the Tuesday following each week’s Sunday and Monday games.  In case of a tie, winner will be determined by the total points scored by both teams in the Monday night game and what the entrant has submitted to KXTE as their point total for the game. The closest to the final score is deemed the winner. In the event there are two games on Monday night the latter game will be the tie-breaker game. Weekly winners will be determined each week after all weekly games are played, as described in Section 1b of these rules.

c. Winners need not listen or be present to win.  Winners will be contacted via phone by KXTE staff on Tuesday after each weeks Monday night game.  If the winners can not be contacted within one (1) business day after the prize is awarded, an alternate winner will be chosen be determined by the second most correct picks.  If the winner was chosen by tie-breaker the alternate winner will be determined by the second closest to the final score total.  

5. Conditions:

a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.

b. By participating in the contest, the winner or winners (and their guests or traveling companions, if any) agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize or prize certificate, KXTE in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold KXTE, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.

d. KXTE, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the KXTE website or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

e. KXTE reserves the right to make changes in the rules of the contest, including the substitution of a prize or prizes of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of KXTE, any of the regularly scheduled football games is rescheduled, postponed or cancelled, KXTE reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.

f. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of KXTE.

g. KXTE is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of the prize.

h. Copies of the written contest rules and a list of all winners (when complete) are available during regular business hours at the main studio of CBS Radio, 6655 West Sahara Ave. Suite D-110, Las Vegas NV. 89146 or by sending a self-addressed stamped envelope to CBS Radio, 6655 West Sahara Ave. Suite D-110, Las Vegas NV. 89146.

6. INTERNET SWEEPSTAKES PRIVACY POLICY

a. By use of this website and by entering the Contest, you agree to the Station’s Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: www.xtremeradio.com.
